homedrops is an online letting agent for London. We act for landlords in letting their property, and run the letting process through our platform: listing the property, booking viewings, exchanging offers, Right to Rent and sanctions checks, generating the tenancy agreement (APT), collecting holding deposit and move-in monies, and tracking the compliance documents required by law.
Where an independent agent lists a property or introduces a tenant through homedrops, that agent acts under their own terms and regulatory obligations, and homedrops provides the platform they use.
We do not own, inspect or vouch for the condition of any property. The APT is generated from our standard template using the details the parties provide. We do not warrant its legal effect, so if you are in any doubt (landlord, tenant or guarantor), have it reviewed by a solicitor before signing.
homedrops takes no responsibility for the condition of any property listed, the truthfulness of listing descriptions or photos, the accuracy of agreed terms between the parties, the outcome of any inventory or referencing report, or the work of any third-party contractor or partner we link to (photographers, inventory clerks, guarantors, insurers, gas engineers, electricians, deposit-scheme providers, etc.).
All third-party partners listed on homedrops (including via the/partners pages or in-app CTAs) operate under their own terms. homedrops is not their agent and does not warrant their performance or pricing.
homedrops collects tenancy money on behalf of the landlord, using Stripe to process payments. That covers the holding deposit and the move-in monies due before the tenancy starts: the first month's rent and the security deposit. Our fees, where charged, are taken at the same time. Card and bank details are handled by Stripe and are not stored by homedrops.
Money collected for a tenancy belongs to the landlord or the tenant, not to homedrops. We only use it for the purpose it was paid for, and every payment is recorded against the tenancy it relates to.
Holding deposit. The holding deposit is capped at one week's rent. Under the Tenant Fees Act 2019 it is either put towards the first month's rent or the security deposit, with the tenant's agreement, or refunded within 7 days. It may be kept only where the Act allows, for example if the tenant gives false or misleading information, fails a Right to Rent check, withdraws, or does not take all reasonable steps to enter into the tenancy by the deadline for agreement (15 days unless both sides agree a different date in writing).
Rent and security deposit. We pass the first month's rent to the landlord, less any fees they have agreed to, once the tenancy has started. We pass the security deposit to the landlord promptly so that it can be protected in a government-approved scheme (DPS, TDS or mydeposits) within 30 days of the tenant paying it, as the Housing Act 2004 requires. The landlord remains responsible for protecting the deposit and serving the prescribed information on the tenant.
Refunds. Where money has to be returned, for example when an offer is withdrawn, we refund it to the card or account it was paid from.
Rent after the first month. If we collect rent for a landlord after the first month, that service runs under separate terms, which we will give both landlord and tenant before it starts.
By using homedrops the landlord agrees to comply with the Equality Act 2010. Decisions about who to accept as a tenant must not be based on receipt of benefits, family status, disability, ethnicity, religion, national origin, sex, sexual orientation or gender identity. homedrops may suspend any account we believe is acting in breach of these rules.
homedrops is a joint data controller with the landlord under UK GDPR for the tenant information shared during the offer and tenancy flow. We surface this information to the landlord (and any agents acting for them) only for the purpose of letting the property. Tenant information must not be shared with third parties without consent, and must be deleted promptly when the tenancy ends.
To the maximum extent permitted by law, homedrops's liability for any loss arising from use of the platform — whether contractual, tortious or otherwise — is limited to the platform fees actually paid to homedrops by the affected user in the 12 months before the event giving rise to the claim. We exclude liability for indirect or consequential loss, loss of profit, loss of rent, or loss of opportunity.
Nothing in these terms limits liability for death, personal injury, fraud, or any other liability that cannot lawfully be limited.
We may change these terms from time to time. Material changes will be highlighted in-app at sign-in and dated above. Continued use after a change means you accept the updated terms.
